StoneSnap Terms of Use

These Terms of Use are a legal agreement between you and Lightning Deals LLC ("Company," "we," "us," or "our") for your access to and use of StoneSnap, including the StoneSnap mobile application, related websites, content, subscriptions, artificial intelligence features, support services, and any other products or services that link to these Terms.
1. The Service
StoneSnap helps users scan, identify, organize, and learn about rocks, minerals, crystals, gemstones, and related specimens. The Service may provide AI-generated identification results, possible matches, educational information, rarity or collector scoring, value estimates, collection tools, scan history, and other related features.
The Service is provided for general informational, educational, and entertainment purposes only.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian.
3. AI Results and Value Estimate Disclaimer
StoneSnap uses automated systems, artificial intelligence, data sources, user-submitted photos, image analysis, and other methods to generate results. These results may be inaccurate, incomplete, outdated, or unsuitable for your circumstances.
StoneSnap does not guarantee that any identification, match, description, rarity score, collector score, value estimate, appraisal-like estimate, or other output is accurate, complete, reliable, or current.
Do not rely on the Service for professional geological, gemological, mining, construction, environmental, safety, financial, legal, medical, or appraisal advice. If accuracy matters, consult a qualified professional, certified appraiser, gemologist, geologist, lab, or other appropriate expert.
4. App Store Terms
If you downloaded StoneSnap from the Apple App Store, your use of the app is also subject to Apple terms. Apple is not responsible for the Service, support, maintenance, warranties, claims, product liability, legal compliance, or intellectual property claims relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms.
5. User Content
"User Content" means any photos, images, videos, text, notes, specimen names, locations, metadata, feedback, messages, support requests, collection data, uploads, or other content you submit, upload, transmit, create, store, or otherwise provide through the Service.
You are responsible for your User Content. You represent that you own or have all necessary rights to your User Content and that it does not violate any law, third-party right, privacy right, intellectual property right, or these Terms.
6. License You Grant to Us
You retain ownership rights you have in your User Content. However, by submitting, uploading, creating, storing, sending, or otherwise making User Content available through the Service, you grant us and our affiliates, service providers, contractors, successors, and assigns a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, transferable, perpetual, irrevocable license to host, store, cache, reproduce, copy, modify, adapt, process, analyze, translate, reformat, create derivative works from, publish, display, perform, distribute, transmit, disclose, commercialize, and otherwise use your User Content, in whole or in part, in any media or technology now known or later developed.
This license includes the right to use User Content to operate, provide, maintain, secure, support, market, promote, and improve StoneSnap; analyze photos and generate AI identifications, descriptions, scores, estimates, and other outputs; develop, test, train, improve, evaluate, and tune machine learning models and related technologies; create aggregated, anonymized, de-identified, or derived data; enforce these Terms; prevent abuse; comply with law; and protect rights, safety, and security.
You agree that you are not entitled to compensation for uses of User Content permitted by these Terms. To the extent permitted by law, you waive moral rights, publicity rights, or similar rights that would prevent us from exercising this license.
7. Acceptable Use
You agree not to use the Service for illegal, harmful, fraudulent, deceptive, abusive, or infringing purposes. You may not upload content you do not have permission to share, bypass paywalls or security controls, interfere with the Service, reverse engineer the app, scrape or copy the Service, use the Service to build competing products or datasets without permission, or misrepresent StoneSnap outputs as professional certification, lab results, appraisals, or guaranteed determinations.
8. Subscriptions, Free Trials, and Purchases
StoneSnap may offer paid subscriptions, including weekly and yearly subscription options, free trials, introductory offers, promotional offers, and other paid features. Available plans, prices, trial lengths, renewal periods, and included features are shown in the app before purchase and may change from time to time.
If you purchase through Apple, payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account may be charged for renewal within 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID subscription settings. Deleting the app does not cancel your subscription. Free trials convert to paid subscriptions unless canceled before the trial ends. Refunds are handled by Apple according to Apple's policies.
9. Premium Features
Premium or Pro features may include scan access, AI-powered analysis, value estimates, rarity or collector scores, specimen profiles, collection tools, and other features. We may add, remove, modify, limit, or discontinue features at any time.
10. Third-Party Services
The Service may rely on or link to third-party platforms, service providers, APIs, analytics tools, attribution tools, payment processors, AI systems, app stores, websites, databases, and other services. We do not control third-party services and are not responsible for their content, policies, availability, security, or practices.
11. Intellectual Property
The Service, including the app, software, design, interfaces, logos, trademarks, graphics, text, databases, models, generated content, features, workflows, documentation, and other materials, is owned by us or our licensors and is protected by intellectual property and other laws.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own personal, non-commercial use.
12. No Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will meet your needs, identify specimens correctly, estimate values accurately, be available at all times, be error-free, or be free from harmful components.
13. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates, officers, directors, employees, contractors, service providers, licensors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for loss of profits, revenue, data, goodwill, use, business opportunity, or value.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid to us for the Service during the three months before the event giving rise to the claim or USD $50.
14. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, contractors, service providers, licensors, and agents from and against claims, damages, losses, liabilities, costs, and expenses arising out of your use or misuse of the Service, your User Content, your violation of these Terms, your violation of law or third-party rights, or your reliance on Service outputs.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida and the laws of the United States, without regard to conflict of law rules, except to the extent local consumer protection law requires otherwise. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally. Claims will be brought only on an individual basis and not as a plaintiff or class member in any class, collective, consolidated, or representative action, to the extent permitted by law.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
